 Bilaa ijazat larki ka nikah aur maiyat par phool charhana





٭Bila ijazat larki ka nikah ٭Roh ko aysalِ sawab aur maiyat par phool daalna

٭maqtadry ke liye sorat Fatiha ki Qira t- ka mehal ٭zakat, sonay ki qeemat khareed par ya qeemat farokht par


Sawal: aik valdne apni jawan, baaligh larki ka nikah is ki ijazat ke baghair –apne kisi rishta daar larke se kardiya hai. nikah se pehlay woh larki bermila pukaar pukaar kar kehti rahi hai ke mein is larke ke sath shadi karne par raazi nahi hon aur ab nikah ke baad bhi woh larki narazgi aur khafgi ka izhaar karte hue –apne rishta daar mardon aur aurton ke samnay rona shuru kardeti hai. a seen nikah ka quran o hadees ki talemaat ki roshni mein kya hukum hai? ( abdalohid, zila qasoor )

Jawab: baaligh larki ka nikah is ki ijazat ke baghair nahi hona chahiye, chahay nikah karne wala is ka baap hi kyun nah ho, chunancha hadees mein hai : 

«Abbu albarek» ( sahih muslim )" baap kanwari larki se nikah ke baray mein is se ijazat talabb kere

Alama ibne qaemya farmate hain:

«وبهذه الفتوی نأخذ وأنه لا بد من استئمار البکر وقد صح عنه ﷺ: الأيم أحق بنفسها من وليها والبکر تستأمر فی نفسها وإذنها صماتها وفی لفظ والبکر يستأذنها أبوها فی نفسها وإذنها صماتها وفی الصحيحين عنه ﷺ: لا تنکح البکر حتی تستأذن، قالوا: وکيف إذنها؟ قال أن تسکت ۔ وسألته ﷺ جارية بکر، فقالت إن أباها زوّجها وهی کارهة، فخيّرها النبیﷺ فقد أمر باستئذان البکر ونهي عن إنکاحها بدون إذنها ۔ وخيّرﷺ من نکحت ولم تستأذن»(اعلام الموقعین، ۴/۳۴۱،۳۴۲)

 Imam sahib farmatay hain : hum is Fatwa ko letay hain ke bakrah se ijazat lena zaroori hai kyunkay nabi? se yeh baat sahih saabit hai ke bewa –apne nafs ki ziyada haqdaar hai aur kanwari se is ke nafs ke baray mein mahswara liya jaye aur is ki khamoshi, ijazat tasawwur hogi aur aik riwayat mein yun hai ke baap bakrah se ijazat talabb kere aur is ki aِjazt is ki khamoshi hai neez bukhari, muslim mein hai ke nabi? ne farmaya : bakrah ka nikah nah kya jaye yahan tak ke is se ijazat li jaye. logon ne kaha : is ki ijazat kaisay ho? aap ne farmaya : is ki khamoshi hi ijazat samjhi jaye gi .

Aur aap? se aik kanwari larki ne sawal kya ke is ke baap ne is ka nikah zabardasti kardiya hai to aap ne is ko ikhtiyar day diya aur hukam diya ke bakrah se ijazat li jaye aur a seen ki ijazat ke baghair nikah se mana kardiya aur jis se ijazat nah li gayi ho, is ko ikhtiyar day diya.

un nasoos ki bana par is larki ko ikhtiyar hai ke yeh nikah rdd kar sakti hai .

sawal: is hadees ki tehqeeq darkaar hai :

 «عن ابن عباس

 أن رسول الله ﷺ نهي عن صبر ذی الروح وعن إخصاء البهائم نهيا شديدا» (مجمع الزوائد: ج۵، ص۲۶۵)

Agar yeh hadees sahih hai to phir janwar ko khassi karna aur khassi janwar ki qurbani karna kaisa hai ?

Jawab: hazrat Ibn abbas razi Allah anho se marwi is hadees ke baray mein imam sho kani Rehma Allah farmatay hain: « وأخرج البزار بإسناد sahih mann hadees Ibn abbas » yani" Ibn abbas razi Allah anho ki hadees ko bzar ne بسند sahih bayan kya hai. ( neel alwatar ) aur sahib majmaa alzaid ne kaha : Rajal sahi is hadees ke Ravi sahih ke Ravi hain. (? / ۲۶۵ ) yani un rawiyoon mein sahih ke rawiyoon jaisay Awsaf paye jatay hain. allama Shams Al Haq Rehma Allah azeem abadi ne –apne Fatawa mein is masla par khoob sair haasil behas ki hai jo Laiq mutalea hai. behas ke aakhir mein farmatay hain :


Un tamam baton ka khulasa yeh hai ke jin janwaron ka gosht nahi khaya jata, un ka khassi karna jaaiz nahi aur jin ka gosht khaya jata hai, un ka khassi کرناافضل hai aur Azimat ka yahi taqaza hai ke un ka khassi karna jaiz ho ". ( safha ۳۳۳ )

Sawal: masood Ahmed bi s si, Ameer jamaat almslmin ( registered ) ne darj zail hadees se saabit kya hai ke soryh Fatiha is waqt parhi jaye jab imam khamosh ho 


"Hazrat abdullah ban Umar razi Allah anho farmatay hain: « کانوا یقرأون خل

رسول اللهﷺ إذا أنصت فإذا قرأ لم يقرء وا وإذا أنصت قرء وا» (بیہقی: جزء القراة / صلوٰة المسلمین 


Is ki sanad kaisi hai? agar sanad sahih hai to soryh Fatiha kis waqt parhi jaye gi? imam ke saktoon mein ya murawaja tareeqa hi sahih hai ?

Jawab: assar haza sanad ke aitbaar se agarchay qabil qubool hai lekin yeh is baray mein nas nahi ke deegar mawaqay par Fatiha ki qiraat nahi hosakti, is kitaab ke safha  par hai : abu-hurera ke shagird ne kaha « فکیف أصنع إذا  الإمام »" jab imam jehri qiraat kere to mujhe kya karna chahiye ?" jawab mein abu huraira ne farmaya : " –apne jee mein parh le." phit behqi ne apni sanad ke sath maqhool se naqal kya hai :


«اِقرأ بها يعنی بالفاتحة فيما جهر به الإمام إذا قرأ بفاتحة الکتاب وسکت سِرّا وإن لم يسکت اقرأ بها قبله ومعه وبعده لا تترکها علی حال»

 Jab imam jehri qiraat kere to is ki khamoshi mein Muqtadi sri qiraat kere. aur agar woh khamosh nah ho to is se pehlay is ke sath aur is ke baad qiraat ko kisi haal mein mat chore. 


Phir hazrat abada ki mashhoor riwayat mein hai ke

Rasool Allah saww ? ne subah ki namaz parhai to qiraat karna mushkil hogaya. salam phairnay ke baad aap ne daryaft kya : mujhe yun mehsoos hota hai ke tum –apne imam ki aqtda mein qiraat karte ho, hum ne arz ki : haan ya rasoolAllah ?! aap ne farmaya siwaye Fatiha ke kuch nah parho, jo Fatiha nahi parhta is ki namaz nahi. "

Is hadees mein imam ki qiraat ke waqt Muqtadi ki qiraat Fatiha ka juwaz hai, agar saktaat mein qiraat katayn hota to aap is ki rahnumaiye farma dete. is amar ki Sarahat nah karna juwaz ki Daleel hai. usool fiqa ka mashhoor qaida hai

: «تأخير البيان عن وقت الحاجة لايجوز»


Zaroorat ke waqt wazahat ko moakhar karna jaaiz nahi.

Sunan abbu daud ki riwayat mein alfaaz yun hain.


«فلا تقرء وا بشيئ من القرآن إذا جهرتُ إلا بأم القرآن»


Jab mein qiraat jehri karoon to siwaye Umm al quran ke quran se tum kuch nah parho. "

yeh alfaaz is baray mein nas hain ke imam ki jehri qiraat ke waqt Muqtadi ke liye Fatiha parhnay ka juwaz hai. imam shokani Rehma Allah farmatay hain :

" Showaaf ka Fatiha ki qiraat ke baray mein ikhtilaaf hai ke aaya qarat Fatiha imam ke saktoon ke douran hogi ya is ki qiraat ke mauqa par? ahadees ke zahir se maloom hota hai ke Fatiha imam ki qarat ke waqt parhi jaye avramam ke sukut ke moqa par agar mumkin ho to parhna ahoot ( ziyada ahthyat ) hai kyunkay aisa karna pehlay qoul walon ke nazdeek bhi jaaiz hai. is par amal karna ijma par amal karne ke mutradif hoga lekin yeh mamool bana lena ke imam ke Fatiha ya sourat ki tilawat ke waqt hi Fatiha parhnay ki sae ki jaye, aisa karna koi mustand nahi balkay sab terhan jaaiz aur sunnat hai. Albata Muqtadi ke liye imam ki qiraat Fatiha ke waqt Fatiha parhna ziyada munasib hai .


Sawal: Zaid ne baker se kaha ke agar woh Zaid ko das laakh rupay day to woh is kakarobar karkay hrmah usay pandrah hazaar rupay munafe day ga jabkay asal raqam bhi mehfooz rahay gi. mazeed yeh ke bakar karobar mein kisi raqam ke nuqsaan ka zimma daar nah hoga, is ki sharai hesiyat kya hai? ( Mohammad Shahid , hujra Shah muqeem, avkarhah )

Jawab: mazarbet ki bunyaad par tijarat karna jaaiz hai jis mein naffa o nuqsaan mein barabar musharkat hoti hai. nuqsaan mein shareek nah hona aur manafa ka mahana taayun karna, dono hi sood ki kasmain hain jis se ijtinab har musalman ka farz hai .

Sawal: aik sahib nisaab shakhs, jis ke paas saarhay saat tolay ya a seen se zayed wazan ka sona hai aur is par saal guzar chuka hai. woh zakat kis hisaab se ada kere ga jabkay hamaray malik mein sonay ke do rate yani qeemat khareed aur qeemat farokht raaij hain kyunkay sunaar sonay ke khout, polish waghera ka naam le kar khud kharedtay hue mukammal wazan ki qeemat nahi dete. aisa shakhs zakat qeemat khareed ke hisaab se ada kere ga ya qeemat farokht ke hisaab se? ( abbu abaid allah, mardan )


Jawab: bulaa shuba zakat khalis sonay par hai. agar woh dali ki soorat mein hai to is mein khout ka sawal hi peda nahi hota, agar woh zewar ki soorat mein hai to is ki zakat mein faqah aُmt ka akhtla f hai, ziyada ahthyat wala maslak yeh hai ke khalis sonay ka hisaab laga kar zewar ki zakat ada ki jaye. zakat ki adaegi mein hisaab qeemat farokht ka lagayen, kyunkay zakat dainay walay ki hesiyat baye jaisi hai, jis ke aiwz is ne Allah se jannat haasil karna hai quran Majeed mein hai :


 ﴿إِنَّ اللَّهَ اشتَر‌ىٰ مِنَ المُؤمِنينَ أَنفُسَهُم وَأَمو‌ٰلَهُم بِأَنَّ لَهُمُ الجَنَّةَ...١١١ ﴾... سورة التوبة 


Allah ne mominoon se un ki jaanen aur un ke maal khareed liye hain ( aur is ke ) aiwz mein un ke liye bahisht ( tayyar ki ) hai. "

Khodko khout ke shuba se pak karlena chahay. hadees mein hai


: «دع ما يريبک إلی ما لا يُريبک» (فتح الباری: ۴/۲۹۳) 


Shuba wali shai ko chore cross ko ikhtiyar kya jaye jis mein shuba nahi. "

Salamti ki raah yahi hai ke Allah se kharay maal ka soda kya jaye kyunkay is ka aiwz khara hai rawa jannat hai jis ke awsaf krimh se kitaab o sunnat bhara para hai .

Sawal: betay ki paidaiesh par dost ne saving sir tifkit ( teen hazaar rupay ) tehfata diya tu bank mein kuch arsa raqam jama rehne par maloom ho a ke woh raqam to sood ki wajah se barh rahi hai. ab asal raqam ki bajaye sood ki zayed raqam kaafi miqdaar mein barh chuki hai aur raqam nikalwa kar istemaal bhi ki ja chuki hai


1 ) Sood wali zayed raqam ka masraf kya hoga ?

2 ) Mein ne jo raqam nikalwa krastamal karli, kya is ka ada karna zaroori hoga ?

3 ) Kuch arsa baad sood ka bharna band karwa diya tha. raqam to barhti gayi is ka kya banay ga ?

4 ) Baaz hazraat ke nazdeek bank mein raqam rakhna hi sahih nahi, ghar mein rakhen to raqam mehfooz nahi, hawala sood ka dete hain. kya kya jaye. ( colonel Naeem poori, Lahore )

Jawab: 1 ) Soodi raqam ka masraf yeh hai ke agar kisi ne soodi paisa dena hai ya is par zulm ki chti pari ho to yeh raqam wahan sirf kar di jaye taakay haraam paisa haraam rasta mein hi jaye .

2 ) Istemaal shuda raqam ko ada karna zaroori hai .

3 ) Is khatah mein sood laziman barhta rahay ga jisay karnde kha jaye ge, lehaza zaroori hai ke saving account ko tabdeel karkay bamer majboor current account mein rakh len, is khatay mein sood nahi lagta aur soodi raqam ko soodi rasta mein ada kar dein .

4 ) Current account mein rakhwaye aur sood se mazeed hifazat ke liye' bank lakar' istemaal karen .

Sawal: marhoom ki rooh ko aysalِ sawab ke liye agar marhoom ke ghar ke afraad waghera ain barsi ke din ya kisi aur din aik hi majlis mein khatam quran shareef ka ihtimaam karlen to is amar ki sharai hesiyat kya hai ?


Jawab: aulaad jo bhi karِkhir sar-anjaam deti hai, a seen ka ajro-sawab maiyat tak pohanchana rehta hai. aysalِ sawab ke liye baqaida makhsoos auqaat mein majalis ka ihtimaam karkay qraanِ Majeed khatam karana kitaab o sunnat se saabit nahi, lehaza is se Ihtiraz karna chahiye. hadees mein hai" mann  ma lais faho rrdd" ( bukhari shareef )" jo deen mein izafah kere, woh mardood hai ". haan Albata marhoom ke liye duaye kher bakasrat honi chahiye jis ke liye koi waqt muqarrar nahi, har waqt hosakti hai, makhsoos dua ke alfaaz yun hain


رَ‌بَّنَا اغفِر‌ لَنا وَلِإِخو‌ٰنِنَا الَّذينَ سَبَقونا بِالإيمـٰنِ وَلا تَجعَل فى قُلوبِنا غِلًّا لِلَّذينَ ءامَنوا رَ‌بَّنا إِنَّكَ رَ‌ءوفٌ رَ‌حيمٌ ١٠ ﴾... سورة الحشر


Ae hamaray Rab! hamein aur hamare bhaiyon ko bakhash day, jinhon ne imaan mein hum se Sabqat ki aur jo imaan laaye, hamaray dilon mein aisay logon ke liye koi keena nah honay day. ae hamaray Rab! be shak to shafqat karne wala, reham karne wala hai. "

Sawal: maiyat per phool daalnay ki sharai tor par kya hesiyat hai ?

Jawab: maiyat par phool daalna kitaab o sunnat aur kher alquran ke amal se saabit nahi, is liye is feal se ijtinab zaroori hai. yeh kufar ki rasam hai jo ahal islam mein sarayat kar chuki hai .
