Islami Riyasat Hakumat Aur Qanoon Ka Masla




Allah taala ki wahi ki roshni mein nabi masoom sale Allah alaihi wasallam Ehkaam islami ki tashkeel taameer karte rahay, jinhein kitaab vasant bhi kaha jata hai. yahi Shariat aur is ka nifaz hai jabkay jadeed sayasiyat mein qanoon saazi mqnnh, is ki tashreeh taameer adliya aur is ka nifaz hukoomat karti hai. nifaz' ka lafz zo maienay hai. chunancha qanoon ka jari hona aur is ki amal dari dono ko' nifaz' kehte hain. Shariat ki urf mein' katabat' ka mafhuum nifaz ke qareeb hai.

jis ka tafseeli naqsha sunnat rasool sale Allah alaihi wasallam muhayya karti hai. goya ummat kitaab Allah ke ilawa sunnat rasool Allah sale Allah alaihi wasallam ki bhi paband hoti hai jis ki hesiyat taa qayamat Abdi hai, Albata agar nabi hukmaran bhi ho jis terhan bani Israel mein pehli dafaa syedna daod sale Allah alaihi wasallam mein Shariat aur hukoomat jama ho gayi theen. to nabi sale Allah alaihi wasallam infiradi aur ijtimai tor par ijtehaad tadbeer bhi karte rahay jisay seerat bhi kehte hain. isi terhan Mohammad rasool Allah sale Allah alaihi wasallam shara ke ilawa hukmaran bhi thay .


Ap saww ki Khilafat e Qanoon

Chunancha huzoor sale Allah alaihi wasallam ki rehlat se khilafat ka daur shuru sun-hwa jis ki aُmt Musalmah nigran hai. nifaz ki takmeel to Mohammad mustafa Ahmed Mujtaba sale Allah alaihi wasallam kar chuke, ab aُmt Musalmah ka kaam is ki nigrani aur amal dari hai. isi silsila mein infiradi satah par har musalman Shariat ka mklf hai to ijtimai satah par millat islamia is ki hifazat aur nigrani ki zimma daar hai jis mein namaz, roza ke ilawa tamam islami ehkaam aajate hain, kyunkay islam jame deen shariyat hai jis mein aqeedah' ebadaat aur khandani rasoom o riwaj ke ilawa tahazeeb moashrat.

Maeeshat aqetadsat aur siyasat hakumat sabhi shaamil hain. islami hukoomat ki jahan yeh zimma daari hai ke deen ki amal dari mein Iqamat salaat aur aetaye zkoh waghera ki amal dari ka dheyaan rakhay, wahan yeh bhi zimma daari hai ke zindagi ke dosray ijtimai mahdanon mein Shariat ki har kher wa barkat ko farogh dainay aur shar zalim ko mitanay ki sae baja laaye jis ke liye Shariat ki istilaah amar balmarof, naahi an almnkr hai .


Amar balmarof, naahi an almnkr ka tasawwur qanoon se ziyada wasee aur buland tar hai jis mein dawat tableeg ke ilawa kher adal ki amal dari aur shar zulam ka safaya dono shaamil hain .


Chunkay qanoon ka mizaaj ziyada tar manfi hota hai is liye asal qanoon woh hai jis ki saza muqarrar ho warna tojehi qawaneen directive laws ziyada tar mqnnh ki khwahisaat ( will ) ka izhaar hotay hain' isi binaa par baaz danishwaron ko yeh mughalta sun-hwa hai ke Shariat ke misbet ehkaam' riyasat qanoon hakumat ki zimma daari nahi hoti. halaank Allah taala ne namaz aur zakat ke ilawa amar balmarof, naahi an almnkr dono ko hukoomat ki bhi zimma daari qarar diya hai, lekin baaz mutajdeen Maroof ko hukoomat ki zimma daari se nikalna chahtay hain' taa ke Shariat bhi mehez qanoon ban kar reh jaye. zair nazar maqalah isi qisam ke mogaltoon ki nishandahi kar raha hai jo hadiya qaryin hai. ( Muhaddas )


Riyasati qanoon –apne musalman shehrion ko kisi jurm ke irtikaab se rokkk sakti aur uss par saza to day sakti hai lekin deen ke ijabi taqazoon mein se namaz aur zkoh ke ilawa kisi cheez ko bhi qanoon ki taaqat se logon per nafas nahi kar sakti. woh misaal ke tor par, unhen roza rakhnay ka hukum nahi day sakti. unn mein se kisi shakhs ke baray mein yeh maloom hojane ke bawajood ke woh sahib glandorf istetat hai, ussay hajj par jane ke liye majboor nahi kar sakti. jehaad o qataal ke liye jabri bharti ka koi qanoon nafiz nahi kar sakti. mukhtasir yeh ke juraim ke muamlay mein uss ka dayera ikhtiyar aakhri had tak wasee hai, lekin Shariat ke aur amer  mein se un do' namaz aur zkoh' ke siwa baqi sab mamlaat dayera ikhtiyar mein nahi hai.

٭ musalmanoon ko roza rakhnay ka hukum nahi day sakti .

٭ unn logon ko jin par hajj farz ho, hajj par jane ke liye majboor nahi kar sakti .

٭ jehaad o qataal ke liye jabri bharti ka koi qanoon nafiz nahi kar sakti .


1.قرآنِ مجید اور ریاست کی اطاعت

1. Quraanِ Majeed aur riyasat ki itaat


Quraanِ Majeed mein Allah aur uss ke rasool sale Allah alaihi wasallam ki itaat ke baad' اولوا الامر' yani hukmraanon ki itaat ka hukum bhi diya gaya hai. Allah taala ka irshad hai :


﴿يـٰأَيُّهَا الَّذينَ ءامَنوا أَطيعُوا اللَّهَ وَأَطيعُوا الرَّ‌سولَ وَأُولِى الأَمرِ‌ مِنكُم ۖ فَإِن تَنـٰزَعتُم فى شَىءٍ فَرُ‌دّوهُ إِلَى اللَّهِ وَالرَّ‌سولِ إِن كُنتُم تُؤمِنونَ بِاللَّهِ وَاليَومِ الءاخِرِ‌ ۚ ذ‌ٰلِكَ خَيرٌ‌ وَأَحسَنُ تَأويلًا ٥٩ ﴾... سورة النساء

Ae imaan walo! itaat karo Allah ki, itaat karo rasool sale Allah alaihi wasallam ki aur unn ki jo tum mein se ehley Iqtidaar hain. phir agar tumahray darmiyan kisi cheez mein ikhtilaaf hojaye to usay Allah aur rasool sale Allah alaihi wasallam ki taraf phair do, agar tum waqai Allah par aur akhirat ke din par imaan rakhtay ho. yahi tareeqa tumahray liye behtar hai aur is ka injaam bohat acha hai.


2. Ahadees aur islami riyasat ki itaat


Sahih ahadees mein bhi musalmanoon ko hukum diya gaya hai ke woh Maroof mein –apne hukmraanon ki itaat karen aur masiat mein itaat nah karen :



Aik mutfiq alaihi hadees yeh hai ke

«السمع والطاعة علی المرء المسلم فیما أحب أو کره ما لم یؤمر بمعصیة فإذا أمر بمعصیة فلا سمع ولا طاعة»


Aik musalman par –apne Ameer ka hukum sunna aur maanna farz hai khuwa is ka hukum usay pasand ho ya napasand, jab tak ke usay masiat ka hukum nah diya jaye. aur jab masiat ka hukum diya jaye to phir koi sama o taat nahi. ( sahih bukhari : ۷۱۴۴, sahih muslim : ۴۷۶۳ )


«إنما الطاعة في المعروف» (صحیح بخاری:۷۱۴۵)

 Itaat sirf Maroof ( ke kamon ) mein hai.


3. Hazrat abubaker ka pehla khutba khilafat

Musalmanoon ke khaleefa awwal syedna abubaker? ne khalifa honay ke baad apni pehli taqreer mein yeh elaan farma diya tha ke


«أطیعوني ما أطعت اﷲ وَرسوله فإذا عصیت اﷲ ورسوله فلا طاعة لي علیکم» (کنزالعمال: ج۵؍ حدیث ۲۲۸۲)

meri itaat karo jab tak mein Allah aur uss ke rasool sale Allah alaihi wasallam ki itaat karta rahon aur jab mein Allah aur uss ke rasool sale Allah alaihi wasallam ki nafarmani karoon to meri koi itaat tum prnhin hai.


is se maloom sun-howa ke islam mein hukmraanon ki itaat sirf Maroof aur jaaiz kamon mein hai, munkir aur masiat ke kamon mein nahi hai .


4. islami riyasat ke faraiz aur ikhtiyarat


﴿الَّذينَ إِن مَكَّنّـٰهُم فِى الأَر‌ضِ أَقامُوا الصَّلو‌ٰةَ وَءاتَوُا الزَّكو‌ٰةَ وَأَمَر‌وا بِالمَعر‌وفِ وَنَهَوا عَنِ المُنكَرِ‌ ۗ وَلِلَّهِ عـٰقِبَةُ الأُمورِ‌ ٤١ ﴾... سورة الحج

Yeh log hain ke agar hum un ko sarzamen mein Iqtidaar bakhsheen ge to woh namaz ka ihtimaam karen ge, zkoh ada karen ge, Maroof ka hukum den ge aur munkir se rokain ge aur injaam car ka maamla Allah hi ke ikhtiyar mein hai.


﴿وَلتَكُن مِنكُم أُمَّةٌ يَدعونَ إِلَى الخَيرِ‌ وَيَأمُر‌ونَ بِالمَعر‌وفِ وَيَنهَونَ عَنِ المُنكَرِ‌ ۚ وَأُولـٰئِكَ هُمُ المُفلِحونَ ١٠٤ ﴾... سورة آل عمران

Aur chahiye ke tum mein aik giroh aisa ho jo neki ki dawat day, Maroof ka hukum kere aur munkir se rokay aur yahi log Falah panay walay hain.


5. Rozay ka hukum aur islami riyasati qanoon


Roza rakhna deen ka aik ijabi taqaza aur aik sharai amar hai aur islami hukoomat jo har Maroof ka hukum day sakti hai, rozay ke Maroof ka bhi hukum day gi. woh pehlay naseehat aur targheeb ke andaaz mein musalmanoon ko is Maroof ki Talqeen kere gi aur agar log uss ki is ikhlaqi tableegh hi se rozay ki pabandi karlen ge to woh qanoon ko harkat mein nahi laaye gi. lekin jo log uss ki is naseehat aur Talqeen par amal nahi karen ge aur ramadaan al mubarak mein sareaam roza khori karen ge to islami hukoomat unn ko qanoon ki taaqat se roza rakhnay par majboor kere gi aur baaz halaat mein munasib saza bhi day gi.


Hazoor sali Allah alaihi wasallam ki wafaat ke baad arab ke jo qabail murtid hogaye thay, un mein aik giroh unn logon ka bhi tha jo kehte thay ke hum namaz to parheen ge lekin zkoh nahi ada karen ge. hazrat abubaker ne unn ko bzorِ Shamsheer adaigi zkoh par majboor karne ka faisla kya. yeh maamla unn ke nazdeek Shariat ke unn wazeh aur Mansoos masail mein se tha jin ke baray mein do rayein nahi hosakti theen. is wajah se is mein onhon ne shoora se mahswara haasil karne ka –apne ko paband nahi samjha balkay roza, namaz, hudood, tazeerat aur is qisam ke dosray masail ki terhan is mein ba-hasiat khalifa ke apni zimma daari kkhuda ke qanoon ki tanfeez samjhi. chunancha onhon ne –apne is نقطۂ nazar ke mutabiq yeh faisla karliya ke agar yeh islami beeet almaal ko zkoh ada nah karen to un ko taaqat ke zor se itaat par mjbo rkya jaye.( islami riyasat : ص۴۰, taba ۲۰۰۶ء دارالتذکیر, Lahore )


6. Hajj ka hukum aur islami riyasati qanoon


Hajj bhi deen ka aik ijabi taqaza aur sharai amar hai. islami hukoomat –apne amal samait tamam sahib istetat logon ko hajj karne par majboor bhi kar sakti hai. yeh maamla bhi pehlay taleem o targheeb aur waza o naseehat se shuru hoga aur jo log istetat ke bawajood hajj karne mein kotahi karen ge, islami riyasat unn ko is frize ki adaigi ke liye qanoon ki taaqat istemaal kere gi. khilafat rashida ke daur mein is ki nazeer mojood hai. chunancha khaleefa doum hazrat Umar ? ka qoul hai ke


«لو ترك الناس الحج لقاتلتهم علیه کما نقاتلهم علی الصلاة والزکوٰة »

 Agar log ( istetat ke bawajood ) hajj karna chore den to mein un se jung karoon ga jaisay hum namaz aur zkoh chorney walon ke khilaaf jung karte hain. ( Dar منثور : ۲؍۳۹۳ )


« لقدهممت أن أبعث رجالا إلی هذه الأمصار فلینظروا کل من کان له جدة،ولم یحج،فیضربوا علیهم الجزیة،ما هم بمسلمین،ما هم بمسلمین» (فتح القدیر:۲؍۲،ابن کثیر:۲؍۸۵،کنز العمال،رقم الحدیث:۱۲۴۰۰)

Mein chahta hon ke tamam shehron aur ilaqon mein kuch aadmi beju jo un logon ka pata chalayein jo istetat ke bawajood hajj nahi karte, taa ke woh un par jaziya ada karen, kyunkay aisay log musalman nahi hain, aisay log musalman nahi hain.


7. Jihaad o qataal ka hukum

Jihaad o qataal bhi deen ka aik aisa ijabi taqaza aur sharai amar hai jis ke baray mein almae islam ka ittafaq aur ijma hai .


Hamein maloom hai ke ghamdi sahib siray se jehaad o qataal ke hukum hi ke munkir hain aur unn ke nazdeek yeh koi sharai hukum nahi hai. lekin kya unn ke nah maan-ne se Shariat ka koi hukum badal sakta hai? ain haqeeqat khud ko Manwa layte hai, maani nahi jati .


8. Jabri taleem aur islami riyasati qanoon


Aaj ki aksar' mohazab reyaston' mein jabri taleem ka qanoon mojood hai jis ki khilaaf warzi par walidain ke liye saza bhi rakhi gayi hai aur koi maqool shakhs is qanoon ki mukhalfat nahi karsaktha. islam mein bhi hsolِ ilm ki bohat takeed ki gayi hai. hadees mein hai ke


«طلب العلم فریضة علی کل مسلم» (ابن ماجہ، رقم :۲۲۴)

( DEEN KA ) ilm haasil karna har musalman par farz hai.


9. Sarkari mansab aur islami riyasati qanoon

Islami riyasat kisi aisay fard ko sarkari ohda o mansab qubool karne ka hukum bhi day sakti hai jo uss ke nazdeek is ka ahal ho, chunancha musannif Abdul Razzaq mein hai ke hazrat Umar Farooq ne mashhoor sahabi Saeed ban Aamir jamhi? ko shaam ke ilaqay hummus ka wali ( governor ) banana chaha to onhon ne inkaar kardiya. is par hazrat umar ne kaha : Allah ki qisam! yeh nahi ho sakta ke tum log khilafat ki saari zimma daari ka boojh meri gardan par daal do aur khud –apne gharon mein aaraam se baith jao .


﴿إِنَّ اللَّهَ يَأمُرُ‌كُم أَن تُؤَدُّوا الأَمـٰنـٰتِ إِلىٰ أَهلِها وَإِذا حَكَمتُم بَينَ النّاسِ أَن تَحكُموا بِالعَدلِ ۚ إِنَّ اللَّهَ نِعِمّا يَعِظُكُم بِهِ ۗ إِنَّ اللَّهَ كانَ سَميعًا بَصيرً‌ا ٥٨ ﴾... سورة النساء

Be shak Allah tumhe hukum deta hai ke amanatain unn ke haq daaron ko pouncha do aur jab logon ke darmiyan faisla karo to insaaf ke sath faisla karo. Allah tumhe kitni achi naseehat karta hai. be shak Allah suneney wala aur dekhnay wala hai.


10. Musalman aurat ka sharai parda

Musalman aurat ka sharai parda bhi deen ka aik ijabi taqaza aur sharai amar hai. islami riyasat musalman khawateen ko sharai parday ka paband karne ke liye pehlay marhalay mein taleem o Talqeen aur naseehat o targheeb se kaam le gi. agar isi se uss ka maqsad poora hojaye ga to woh qanoon ki taaqat istemaal nahi kere gi. lekin waaz o naseehat ke bawajood jo musalman khawateen sharai parday ki pabandi nahi karen gi, unn ke khilaaf qanoon ki taaqat istemaal ki jaye gi .


Ab sawal yeh hai ke jab roza qanoon hai, hajj qanoon hai aur qurbani qanoon hai to aik islami hukoomat –apne un' qawaneen' ko nafiz kyun nahi kar sakti. sab jantay hain ke qanoon cheez hi aisi hoti hai jisay haar riyasat  taaqat ke zor se nafiz karti hai. phir kya islami riyasat apahaj aur itni be bas hoti hai ke woh Allah ke ehkaam o qawaneen ki tanfeez nahi kar sakti aur is ke liye taaqat istemaal nahi kar sakti .
